By downloading, installing, or using any SmartPrep Labs application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.
2. Description of Service
SmartPrep Labs provides AI-powered mobile applications for exam preparation, including but not limited to:
- IELTS Speaking and Reading preparation
- PTE Core preparation
- Language learning and pronunciation tools
- AI-powered feedback and analysis
- Practice tests and mock exams
3. User Accounts
To access certain features, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized access
4. Subscriptions and Payments
Free Features: Some features are available for free with limitations.
Premium Subscriptions: Premium features require a paid subscription. Subscriptions are billed through Google Play Store or Apple App Store according to their respective terms.
Cancellation: You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.
Refunds: Refunds are handled according to Google Play or Apple App Store policies.
5. Acceptable Use
You agree not to:
- Use the App for any illegal purpose
- Share your account with others
- Attempt to reverse engineer or modify the App
- Use automated systems to access the App
- Interfere with the proper functioning of the App
- Copy, distribute, or create derivative works from our content
- Use the App to harass, abuse, or harm others
6. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, audio, and software, are owned by SmartPrep Labs LLP and are protected by international copyright, trademark, and other intellectual property laws.
7. AI-Generated Content
Our Apps use artificial intelligence to provide feedback and analysis. While we strive for accuracy:
- AI-generated feedback is for educational purposes only
- Scores and predictions are estimates and may not reflect actual exam results
- We do not guarantee specific outcomes on actual exams
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:
- The App will be uninterrupted or error-free
- Results will meet your specific requirements
- Any errors in the App will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTPREP LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.
10. Indemnification
You agree to indemnify and hold harmless SmartPrep Labs LLP from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions.
