Terms of Use

These terms govern the use of the TCF Canada Mock Exam mobile application (the “App”), published by SmartPrep Labs (“we”, “us”). By using the App, you agree to these terms.

1. Description of Service

TCF Canada Mock Exam is a preparation app for the Test de connaissance du français pour le Canada (TCF Canada). It offers:

• Listening and reading comprehension exercises (CO/CE).
• Written and oral expression exercises (EE/EO) with AI-powered evaluation.
• Full mock exams simulating real test conditions.
• Personalized training adapted to your weak areas.
• Progress tracking and an NCLC/CRS calculator.

2. User Account

• An account is required to use the App.
• You are responsible for the security of your account and all associated activity.
• You must provide accurate information when signing up.
• We reserve the right to suspend or delete an account in case of violation of these terms.

3. Subscription & Payment

• Free version: unlimited access to CO/CE questions, 1 AI evaluation (EE and EO) per day, 1 mock exam, 1 training session per day.
• Premium version: unlimited AI evaluations, 15 mock exams per month, unlimited training sessions, detailed analytics.
• Payments are processed by the App Store (Apple) or Google Play Store depending on your platform.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Refund policies are those of Apple or Google, as applicable.

4. Intellectual Property

• The App, its content (questions, texts, audio recordings), and its source code are the property of SmartPrep Labs.
• Using the App does not grant you any intellectual property rights.
• Reproducing, distributing, or modifying the App’s content without written permission is prohibited.
• TCF and TCF Canada are trademarks of France Éducation international. SmartPrep Labs is not affiliated with France Éducation international or IRCC.

5. Limitations of Liability

• The App is a preparation tool. Scores obtained do not constitute official TCF Canada results.
• AI evaluations are indicative and do not guarantee a specific level on the official exam.
• TCF → NCLC → CRS conversions are based on official IRCC tables but are provided for informational purposes only.
• We do not guarantee uninterrupted availability or the absence of errors.
• In no event shall SmartPrep Labs be liable for indirect damages related to the use of the App.

6. Acceptable Use

You agree not to:

• Use the App for illegal or unauthorized purposes.
• Attempt to bypass the limitations of the free version.
• Decompile, disassemble, or reverse-engineer the App.
• Share your account with others.
• Collect data from other users.
• Use bots, scripts, or automated tools to interact with the App.

7. Artificial Intelligence

• Evaluations of your written and oral productions are performed by AI models (OpenAI).
• Results are generated automatically and may contain imperfections.
• Your data is not used to train third-party AI models.

8. Changes

We may modify these terms at any time. Significant changes will be notified within the App. Continued use of the App after notification constitutes acceptance of the new terms.

9. Termination

You may stop using the App at any time and request deletion of your account. We may terminate or suspend your access if you violate these terms.

10. Governing Law

These terms are governed by the laws of the Province of Quebec and Canada. Any disputes shall be submitted to the competent courts in Montreal, Quebec.
