1. Acceptance of Terms

By downloading, installing, or using PTE Academic Prep ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users, including free and premium subscribers.

2. Description of Service

PTE Academic Prep is an AI-powered mobile application designed to help users prepare for the Pearson Test of English (PTE) Academic examination. Features include:

• Speaking, Writing, Reading, and Listening practice tasks
• AI-generated feedback powered by Google Gemini and OpenAI
• Mock exam simulations
• Personalised daily training plans
• Progress analytics

The App is not affiliated with, endorsed by, or connected to Pearson Education Ltd.

3. User Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date.

You must be at least 13 years old to create an account.

4. Subscriptions & Payments

The App offers both a free tier and premium subscription plans (1, 3, 6, or 12 months). Subscriptions are processed through the Apple App Store or Google Play.

• Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date
• You may cancel at any time through your App Store / Google Play account settings
• No refunds are provided for partial subscription periods, except as required by applicable law
• Prices may change with prior notice

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the App's source code
• Share your account credentials with others
• Use automated tools to access the App or its API
• Upload harmful, offensive, or illegal content

6. AI-Generated Content

The App uses AI to generate feedback, questions, and scoring. AI feedback is for educational purposes only and may not perfectly replicate official PTE scoring. We do not guarantee any specific exam score as a result of using the App.

7. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, icons, and software, is the property of SmartPrepLabs and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, or create derivative works from any App content without our written permission.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that AI feedback will be accurate or suitable for your specific exam preparation needs.

9. Limitation of Liability

To the maximum extent permitted by law, SmartPrepLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time via the App or at smartpreplabs.com/delete-account.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes. Continued use of the App after changes constitutes acceptance of the new Terms.
