Terms of Use (EULA)

These Terms of Use ("Terms") govern your use of the IELTS Writing 2026 Practice mobile application ("App") developed and operated by SmartPrep Labs ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

The App provides IELTS Writing practice tools including AI-powered essay evaluation, mock exams, daily training, and progress tracking. The App is an independent educational tool and is not affiliated with, endorsed by, or connected to the British Council, IDP, or Cambridge Assessment English.

3. User Accounts

• You may use the App as a guest or create an account via Google or Apple Sign-In.
• You are responsible for maintaining the confidentiality of your account.
• Guest accounts store data locally on your device; signing in enables cloud sync.

4. Subscriptions and Payments

• The App offers a free tier with limited features and a Premium subscription with additional features.
• Premium subscriptions are billed through Apple App Store or Google Play Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Payment is charged to your App Store or Google Play account at confirmation of purchase.
• You can manage and cancel subscriptions in your device's subscription settings.
• No refunds are provided for partial subscription periods. Refund requests must be directed to Apple or Google.

5. Free Trial

If offered, a free trial automatically converts to a paid subscription unless cancelled before the trial ends. Unused portions of a free trial are forfeited upon purchasing a subscription.

6. AI-Generated Content

• The App uses artificial intelligence (Gemini, GPT) to evaluate essays and provide feedback.
• AI feedback is for educational purposes only and should not be considered an official IELTS score or guarantee.
• We do not guarantee the accuracy of AI-generated evaluations, scores, or suggestions.
• Actual IELTS scores may differ from AI predictions.

7. User Content

• You retain ownership of essays and text you submit to the App.
• By submitting content, you grant us a limited license to process it for providing the service (AI evaluation, storage, sync).
• We do not sell or share your essays with third parties for marketing purposes.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Distribute, sublicense, or resell the App or its content.
• Use automated systems to access the App in a manner that exceeds reasonable use.
• Submit offensive, harmful, or inappropriate content.

9. Intellectual Property

All content, design, code, and features of the App are owned by SmartPrep Labs and are protected by intellectual property laws. IELTS is a registered trademark of University of Cambridge ESOL, the British Council, and IDP Education Australia. Our use is solely descriptive.

10. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or that AI evaluations will be accurate. Use the App at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, SmartPrep Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, exam results, or any reliance on AI-generated feedback.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App and delete your account at any time.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of significant changes through the App.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law provisions.
