Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Goethe Mock Exam mobile application (the "App") operated by SmartPrep Labs ("we", "us", or "our"). By downloading, installing, accessing, or using the App, you agree to these Terms.

1. Use of the App

The App provides German exam preparation tools for Goethe-Zertifikat levels A1 through C2, including practice tasks, mock exams, progress tracking, reminders, AI-assisted feedback, transcription, and related learning features.

You may use the App only for lawful, personal, non-commercial educational purposes and in accordance with these Terms.

2. Accounts

• You may need to sign in to access certain features, sync progress, or use subscription benefits.
• You are responsible for maintaining access to your account and keeping your sign-in credentials secure.
• You must provide accurate account information and must not impersonate another person.
• We may suspend or terminate accounts that violate these Terms or abuse the App.

3. Subscriptions and Purchases

• The App may offer free and paid features, including subscriptions or in-app purchases.
• Purchases are processed by Apple App Store or Google Play. We do not process or store your full payment card details.
• Subscriptions renew automatically unless cancelled through your Apple App Store or Google Play account settings before the renewal date.
• Refund requests are handled by Apple or Google according to their policies.
• Deleting the App or deleting your account does not automatically cancel an active store subscription.

4. AI Feedback and Exam Scores

• The App may use artificial intelligence to evaluate writing, speaking, transcription, OCR, or mock exam responses.
• AI feedback, scores, bands, levels, comments, and recommendations are educational estimates only.
• The App does not provide official Goethe-Institut scores, certificates, admissions decisions, or guarantees of exam results.
• You should use AI feedback as study guidance, not as a substitute for official exam evaluation or professional instruction.

5. User Content

You retain ownership of text, audio, images, and other content you submit to the App. You grant us a limited license to host, process, transmit, and analyze your content only as needed to provide and improve the App, including AI evaluation and sync features.

You must not submit content that is unlawful, abusive, defamatory, infringing, harmful, or designed to attack, overload, or manipulate the App or its providers.

6. Intellectual Property

The App, including its software, interface, design, original content, scoring logic, generated non-user materials, and branding, is owned by SmartPrep Labs or its licensors and is protected by intellectual property laws.

You may not copy, resell, reverse engineer, scrape, redistribute, or create competing datasets from the App except where allowed by applicable law.

7. Acceptable Use

You agree not to:

• Use the App for unlawful, fraudulent, or abusive purposes.
• Bypass paywalls, subscriptions, quotas, security checks, or access controls.
• Use modified clients, patched apps, automated scripts, or replayed requests to gain unauthorized access.
• Upload malware or content that infringes another person's rights.
• Interfere with the App, Firebase, RevenueCat, AI providers, or related services.

8. Third-Party Services

The App relies on third-party services such as Firebase/Google Cloud, RevenueCat, Apple App Store, Google Play, and AI or speech providers. Your use of those services may also be subject to their own terms and policies.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy.

10. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, secure, or that AI feedback will be correct.

11. Limitation of Liability

To the maximum extent permitted by law, SmartPrep Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, lost opportunities, exam outcomes, subscription issues caused by store platforms, or reliance on AI-generated feedback.

12. Termination

You may stop using the App at any time. We may suspend or terminate access if we believe you violated these Terms, created security risk, abused subscriptions or quotas, or used the App in a way that may harm users, the App, or service providers.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new "Last updated" date. Continued use of the App after changes means you accept the updated Terms.
